Question.  My wife's niece has a visa for 21/2 more years.  However, her visa is stamped until December 18, 2010.  Is it possible for her to leave the country for a few days and  then return, getting her visa stamped until June 2011, or so, without actually returning to the Ukraine?   We are considering Canada or Dominican Republic.  Can you please offer us some advice,  Attorney's are expensive.

What proves that she's legal to be here for another 2.5 years?  I thought the visa sticker in passport is the proof.

Her visa is a travel visa for 5 years.  However, terms and conditions of visa of this type say she can only stay in country 6 months at a time and then must leave.  It's okay to return for another 2 1/2 years at her pleasure.  Evidently, she must actually leave the country and then return within a few days.  Hence my question,  someone here may know information on how this may be done cheaply. 

We were told by attorney that she cannot convert travel visa into green card application.

II believe there is also a requirement that a person cannot be in US for more than 6  month in a year on B1/B2 visa.

Since you are married, it is a special circumstance, USCIS may consider changing her status.  You should try to talk to them.
